RESPONSABILIDADES Y OBLIGACIONES DE UN TUTOR POR UNA PERSONA DECLARADA INCAPAZ

BUENAS TARDES
UN INCAPAZ DECLARADA POR EL JUZGADO POR ENFERMEDAD DE DEMENCIA DE 95 AÑOS ESTA REGISTRADA EN UNA ACTIVIDAD EMPRESARIAL DE COMERCIALIZACIÓN DE COMPRA VENTA Y ENGORDA DE ANIMALES Y SE PUEDE EJERCER ESTA ACTIVIDAD A TRAVÉS DEL TUTOR AUN Y CUANDO NO ESTA LUCIDA PORQUE SEGÚN EL JUZGADO SOLO SE PUEDE EJERCER ACTOS DE ADMINISTRACIÓN Y NO DE VENTAS DE SUS BIENES GRACIAS

Revisa el Código Civil, la respuesta no está del lado fiscal.
 
Lo importante no es saber, sino tener el teléfono del que sabe.

De acuerdo al Art. 26 del CFF...Son responsables solidarios con los contribuyentes:

VI. Quienes ejerzan la patria potestad o la tutela, por las contribuciones a cargo de su representado.

En efecto la Corte debieron haberse nombrado un tutor y el debe responder por sus obligaciones fiscales, derivado a que es incapaz de hacer cargo de sus obligaciones, y esta persona debe ser su representante legal de manera imprescindible.

En su caso, al remitirnos al Código Civil Federal, en su artículo 449, 450 y en general el Capítulo I del Título Noveno.
