LA COMPENSACION SE PRESENTO EN PAGO PROVISIONAL COMPLEMENTARIO EN JUNIO DE 2008

LA DECLARACION DE 2008 TIENE COMPLEMENTARIA POR DICTAMEN
PRESENTADA EN AGOSTO DE 2003

EL S.A.T. HA COMUNICADO A LA EMPRESA QUE EL CREDITO A SU FAVOR HA PRESCRITO DEBIDO A QUE YA PASO EL PLAZO DE LOS 5 AÑOS O PIDE EL FUNDAMENTO PARA ACLARAR :!:

EN NUESTRA OPINION EL PLAZO PARA SOLICITAR LA DEVOLUCION O COMPENSACIÓN VENCE EN AGOSTO DE 2008 DEBIDO A QUE EN AGOSTO DE 2003 PRESENTO DECLARACION COMPLEMENTARIA :arrow:

HASTA DONDE OBSERVO, TENICAMENTE PROCEDERIA, YA QUE EL DICTAMEN PRESENTADO EN 2003 AGOSTO "QUEBRÓ" LA PRESCRIPCION.........PERO, TE RECOMIENDO LEER DETENIDA Y "SEMANTICAMENTE" EL CONTENIDO DE LOS ARTICULOS RESPECTO DE "SI PRODECE SOLO PARA "LA GESTION DE COBRO"

SOLO ME QUEDARIA LA DUDA DEL EFECTO DE HACER RETROACTIVO UN BENEFICIO DE LEY IETU HACIA 2002 CUANDO ESTA SU VIGENCIA ES EN 2008........POR AHI HAY JURIS QUE LO IMPIDEN

[color=green:7e5fa29d8a]Esta declaracion debio haberse presentado el 31 marzo 2003 si es persona moral o 30 abril 2003 si es persona fisica

A partir de esta fecha comienza el conteo de la PRESCRIPCION o antes si se presentaron las declaraciones ANTES de las fechas senaladas. En el caso de que se trate de declaraciones anual con saldos a favor por ese ejercicio 2002[/color:7e5fa29d8a][/b:7e5fa29d8a]

LA COMPENSACION SE PRESENTO EN PAGO PROVISIONAL COMPLEMENTARIO EN JUNIO DE 2008

[b:7e5fa29d8a][color=green:7e5fa29d8a]Supongo que la fecha seria que entre el 1 y el 17 de Julio 2008, ya se excedieron por los 5 anos pues se vencieron el 31 de marzo de 2008 y 30 de abril de 2008 dependiendo del tipo de contribuyente moral o fisica.[/color:7e5fa29d8a][/b:7e5fa29d8a]

LA DECLARACION DE 2008 TIENE COMPLEMENTARIA POR DICTAMEN
PRESENTADA EN AGOSTO DE 2003

[b:7e5fa29d8a][color=green:7e5fa29d8a]Resulta que las complementarias no causan reincio en el conteo de la prescripcion, ni suspenden el plazo[/color:7e5fa29d8a][/b:7e5fa29d8a]

EL S.A.T. HA COMUNICADO A LA EMPRESA QUE EL CREDITO A SU FAVOR HA PRESCRITO DEBIDO A QUE YA PASO EL PLAZO DE LOS 5 AÑOS O PIDE EL FUNDAMENTO PARA ACLARAR :!:

[b:7e5fa29d8a][color=green:7e5fa29d8a]Pues es lo que ya te he explicado de manera por menorizada, y tiene toda la razon el SAT a menos que se pruebe que existe una suspension del plazo por prescripcion, donde el contribuyente realizo un aviso de compensacion o de devolucion previo al que estarian realizando y que desconoce la autoridad, por el cual no habria dado alguna resolucion.[/color:7e5fa29d8a][/b:7e5fa29d8a]


EN NUESTRA OPINION EL PLAZO PARA SOLICITAR LA DEVOLUCION O COMPENSACIÓN VENCE EN AGOSTO DE 2008 DEBIDO A QUE EN AGOSTO DE 2003 PRESENTO DECLARACION COMPLEMENTARIA :arrow:
